BREACH OF CONTRACT

Contracts, Mergers, Breach of Contract Law

In order for your claim to qualify as a breach of contract in a court of law, you must be able to prove the existence of three elements:

  1. Proof of the existence of a contract. The courts will require concrete evidence that a contract exists, and it may not be as simple as a handshake, a verbal agreement, or even a signed document. You will have to prove there was (a) an offer, (b) an acceptance of the offer, and (c) consideration was given in the interest of accepting the offer.

  2. Proof that the opposing party failed to perform or provide their obligations and that they did not have a substantial reason for not doing so

  3. Proof that the other party’s failure to perform or provide resulted in damages

If your claim meets all three of these qualifications, you may have grounds for legal action and should seek the help of an attorney.

CIVIL & COMMERCIAL

Property Disputes, Personal Injury

People get hurt when other people are negligent. In 2020, nearly 61,000 people were injured in Missouri automobile accidents alone. Thousands of other people were victims of circumstances involving hazardous premises, dangerous products, medical errors, and more.

Negligence causes more than physical and emotional injuries. The cost of medical treatment and wages lost while unable to work can be staggering. Pain and suffering can be exhausting. There is a way you can try to recover some of the damages you have incurred.

At Calwise & Polanski Law, we help clients injured by someone else’s negligence pursue personal injury claims. Often, no amount of money can truly compensate you for what you have suffered, but it can help you recover some of what you have lost. TRUST WILLS & PROBATE

Estate Management, Property Management, Mortgages

Unlike some other states, Missouri does not require reliance on attorneys to buy or sell real estate. Real estate agents and brokers, title insurance representatives, escrow officers, mortgage lenders, and others are usually the professionals with whom buyers and sellers interact.

The question still looms, however: If you’re either a buyer or a seller, should you still seek the assistance and legal advice of an experienced real estate attorney? The answer is often yes.

Unforeseen roadblocks and obstacles often plague real estate transactions. The National Association of Realtors (NAR) estimates that 30 percent of home sales experience contract delays due to unforeseen problems, often relating to financing and titling. At least five percent of home sales are terminated by either the buyer or the seller.

Fortunately, attorneys are able to identify and address these issues to expedite the process and protect the interests of both buyer and seller.

If you’re in the process of buying or selling real estate in or around Springfield, Missouri, contact the attorneys at Calwise & Polanski Law. We’ll work with you every step of the way, identify issues and potential problems, and help you and the other party resolve your situation so that the agreement goes through to closing with both buyer and seller getting what they want.

In addition to Detroit, our real estate attorneys also proudly serve clients in Springfield, Kansas City, and O'Fallon.
